PPL Montana's Hydroelectric Project on the Upper Missouri River, Montana
The U.S. Supreme Court has issued its decision in PPL Montana v. State of Montana, a fascinating case that combines the colorful history of the American West, the issue of the public?s access to state waterways, and a dispute over hefty royalties claimed to be owed the State of Montana for unpermitted use of public lands by a private energy company.
In a unanimous opinion authored by Justice Anthony Kennedy, the Supreme Court ruled that Montana state courts had misapplied federal law in finding the Upper Missouri, Madison and Clark Fork Rivers in Montana to be navigable for title purposes.
The State of Montana claimed that all three rivers are navigable under federal law, and that their beds and banks are therefore public lands owned by Montana in its sovereign capacity under public trust principles.? PPL Montana, by contrast, argued that the rivers are non-navigable under federal law; that their beds and banks are therefore private property; and that consequently the company is not obligated to pay the state royalties for PPL Montana?s installation and operation of ten hydroelectric facilities on the three waterways.? The Montana state courts had sided with the State of Montana, concluding that the rivers are navigable and therefore publicly-owned under federal law.
Not so, declared the U.S. Supreme Court.? The justices found that the Montana courts had misapplied the so-called federal title test of navigability.? That venerable legal standard limits navigability to those rivers that ?are used, or are susceptible of being used, in their ordinary condition, as highways for commerce, over which trade and travel are or may be conducted in the customary modes of trade and travel on water.?? Critically, navigability under this test is determined not by present-day conditions, but as of the time of statehood?in Montana?s case, in 1889.
Specifically, Justice Kennedy opined for the Court, the Montana Supreme Court made two critical errors in applying the federal title test of navigability here: first, the state court had ignored U.S. Supreme Court precedent requiring that a river?s navigability be determined on a segment-by-segment basis.? Instead, the lower court had declared the three rivers navigable notwithstanding the fact that there were undisputed, ?short interruptions? to navigability along several reaches of the disputed waterways.? That misconstrued?and improperly expanded?the federal title test of navigability.
Second, the Montana state courts had relied in part on present-day evidence of the Madison River?s navigability, including use by modern recreational craft.? According to Justice Kennedy, while use of such contemporary evidence is not improper per se, it is only relevant if: a) the modern recreational watercraft are ?meaningfully similar? to watercraft that plied the river for commercial purposes at the time of statehood; and b) the post-statehood condition of the river is not materially different from its condition upon the state?s admission to the Union.? The Montana Supreme Court had made neither of these findings, observed the U.S. Supreme Court, so its ultimate conclusion that the Madison is navigable for title purposes was fatally flawed.
The justices remanded the case to the Montana courts, with instructions to reconsider their navigability finding based on the principles set forth in Justice Kennedy?s opinion.? But it appears unlikely that much of the state court?s navigability ruling in favor of the State of Montana can or will be sustained on remand.? For example, five of PPL Montana?s ten disputed hydro facilities are located on a single, 17-mile, stretch of the Upper Missouri River (the so-called ?Great Falls? reach), a segment that Justice Kennedy categorically declares in his opinion to be non-navigable.
The Supreme Court?s ruling in PPL Montana comes as no great surprise.? The Montana Supreme Court?s now-reversed opinion did play rather fast and loose with certain aspects of the longstanding, multifaceted federal title test of navigability.? At the same time, the U.S. Supreme Court?s decision appears to interpret and apply that test in a somewhat narrower manner than had its earlier navigability precedents.
One aspect of the Court?s decision in PPL Montana is particularly troubling.? The State of Montana had argued that an adverse ruling on the disputed rivers? navigability would undermine the state?s administration of its public trust responsibilities.? In rejecting this point, Justice Kennedy and the Court seemingly misconstrue the parameters of the public trust doctrine and disregard its longstanding legal nexus to sovereign ownership of the beds of state waterways.? According to Kennedy?s opinion, ?the public trust doctrine concerns?public access to the waters above [river]beds for purposes of navigation, fishing and other recreational purposes.?? But while public trust uses unquestionably include those enumerated by Kennedy, they are actually far broader, and include such ?uses? as commerce, ecosystem preservation, and environmental study.
Hopefully, the Court?s unduly crabbed enumeration of public trust purposes will do no long-term doctrinal damage. ? Later in this portion of the opinion, the Court stresses that the public trust doctrine is a creature of state, rather than federal law.? Thus, state courts around the nation should have the final word in determining the scope and proper interpretation of the public trust within their respective jurisdictions.? And, given the U.S. Supreme Court general hostility to environmental principles in recent years, that?s not a bad thing.

MORGANTOWN, W.Va. (AP) ? West Virginia University announced Tuesday it has settled a lawsuit with the Big East for an unspecified amount, clearing the way for the conference power Mountaineers to join the Big 12 in July in time for the fall football season.
Athletic Director Oliver Luck said the terms of the deal were confidential and WVU wouldn't release details. But Luck said no state, taxpayer, tuition or other academic dollars will be used in the settlement.
A person familiar with the agreement said the settlement totaled $20 million but did not know how much money would come from the university and how much the Big 12 may contribute. The person spoke on condition of anonymity because financial terms were not being made in the announcement of the agreement.
Luck said the funding will come only from private sources and money that athletics raised independently. WVU has already paid half of the required $5 million exit fee to the Big East.
Luck said the new relationship puts WVU among peers that are also large, public, flagship institutions for their states and have strong academic and research programs. Athletically, it's "challenging and competitive" group, he said, populated by schools with "tremendous legacies, passionate fan bases."
It's also lucrative: Luck said WVU should get about $18 million to $19 million a year in television payouts, about double what it gets from the Big East. Payments are being prorated for the first three years at 50 percent, 67 percent and 87 percent, he said, reaching 100 percent in the fourth year.
"It's a very healthy television payout, and it's important we maintain our self-sufficient status," Luck said. "With this move, we'll be in an excellent position to do so."
A spokesman for the Big 12 didn't immediately comment on the deal, but the conference released its football schedule about an hour after the announcement. West Virginia will make its Big 12 debut on Sept. 29 at home against Baylor.
The Mountaineers and their explosive offense went 10-3 last season and finished ranked in the Top 25. West Virginia capped off the season with a record-setting 70-33 victory over Clemson in the Orange Bowl.
Luck didn't rule out the possibility of a nonconference game against archrival Pitt after the 2012 season but said that both schools have nine nonconference games and a matchup would be "difficult to schedule."
"It's pretty obvious there will be no Backyard Brawl" in 2012, he said.
WVU sued the Big East in Monongalia County Circuit Court in Morgantown in November, challenging its bylaws in a bid to join the Big 12 in time for the 2012 season.
The Big East countersued in Rhode Island four days later, arguing that WVU had breached its contract with the conference and should remain in the Big East for another two years as required in the bylaws. In late December, the judge there denied WVU's motion to dismiss.
Luck said the Big 12 gives WVU "significant advantages" over the Big East.
"The Big 12 is a strong and vibrant conference academically and athletically," he said in a statement. "We look forward to the potential academic and athletic partnerships and financial opportunities that membership in the Big 12 offers."
WVU President James Clements called the partnership with the Big 12 "an investment in WVU's future."
Big East Commissioner John Marinatto had repeatedly said West Virginia would not be allowed to leave until the 2014 football season.
But in a statement Tuesday, Marinatto said the board of directors voted to terminate WVU's membership in the conference as of June 30. Marinatto said the board agreed to the deal because WVU was willing to drop its lawsuit and pay an exit fee "well in excess of that required by the bylaws."
He said WVU has agreed to have the West Virginia court enter a judgment that declares the Big East's bylaws "valid and enforceable."
With its recent additions, Marinatto said, "the future for the Big East Conference has never been brighter."
Boise State, Central Florida, Houston, Memphis, San Diego State University, Southern Methodist University and Navy have all recently joined the conference.
The Big East still has work to do to figure out how next season will play out. Pittsburgh and Syracuse announced in September they are leaving for the Atlantic Coast Conference, but have said they will not challenge the Big East's notification rules.
That leaves the Big East with seven football teams for 2012 and a hole in the schedule that could leave its remaining members scrambling to find a game so late ? unless one of its future members can be convinced to join a year early.
Boise State, which is joining the Big East in football only, has been approached about leaving the Mountain West early.
The urgency of the lawsuits and the eventual settlement was driven by football, but the conference realignment affects other West Virginia sports. The Mountaineers must find a home for their men's soccer team because the Big 12 doesn't sponsor the sport.
Teams in rifle, wrestling and women's gymnastics at West Virginia compete in other conferences besides the Big East.
Big 12 membership requires WVU to add a men's sport, but Luck said he hasn't determined which it will be or when it will happen.

In the third and final installment of The Real Housewives of Beverly Hills reunion Monday, the 47-year-old explained her erratic behavior on the Bravo series.
"I'm an alcoholic," Richards told host Andy Cohen. "I have so much guilt and shame for my behavior and what I did. And then I drank to cover the guilt and shame."

Richards completed her third stint in rehab in January. "I'm a person that has done it and relapsed and done it. But at least I'm trying," the former child star said. "I felt off. I just didn't like me anymore and I couldn't look at myself in the mirror anymore."
Watching The Real Housewives of Beverly Hills was too much for Richards to bear.

"When I first started the season, I was still not drinking and you could see my confidence level. And then you could see just from my behavior when I lost my confidence and started drinking," she said. "I could not watch the show when I saw that behavior coming out of myself because I was so ashamed of what I'd done."
Richards then agreed to watch footage from one of the final episodes, where she appeared intoxicated while scrounging around for her belongings on the bathroom floor.

"I don't know what the heck is going on there, but I felt bad for her," Richards said. "It's just sad. The voice wasn't mine, the mannerisms weren't mine. It just wasn't me."
The Bravo star is determined to stay sober this time around. "I just really want this," she explained. "I'll work really hard for it every day."

The Civil Wars are not only nominated for two awards at the 2012 Grammys on Sunday night (February 12), but on Monday, the music video for their Taylor Swift-assisted "Hunger Games" soundtrack song, "Safe & Sound," will drop during "MTV First: Taylor Swift." The video will premiere at 7:54 p.m. ET on MTV, followed by an exclusive chat with Swift herself on MTV.com.
"I just appreciate that we had such horrible working conditions," the Wars' Joy Williams joked to MTV News on the 2012 Grammys red carpet. "We were in a heated cabin. She, being the prima donna that she is, was out barefoot, in freezing weather, in the mud and still managed to have a really good attitude about it."
Bandmate John Paul White added with a laugh: "We figured it was the least that she could do, since we wrote the song. 'I'm the biggest star in the world,' " he joked about the humble pop songstress.
The Barton Hollow singers admit they initially weren't sure about working with another artist on the track, but that after it was suggested to them, it just felt right. "It was [perfect], strangely enough. John Paul and I write all of our own music, so it's not as common anymore for us to be collaborating with other people," Williams said. "But, [producer] T-Bone [Burnett] and Taylor Swift: It was just natural."
After Monday's video premiere — which will also air live on MTV's channels in Canada, Europe, Latin America, Australia, Asia and Africa — the Grammy-nominated Swift will sit down with MTV News' Sway Calloway for a 30-minute interview on MTV.com. I?ve been to this restaurant only for their happy hour in the lounge which serves a tapas menu, but I have yet to try their actual steak dinners. But their Happy Hour is a really?good deal. It?s Tuesday through Thursday (5pm-8pm)?and all drinks and tapas are 50% off. Their food is pretty good, but they are drinks are amazing!

Decor: It?s a very modern restaurant?with?dark lighting, it has a pretty romantic feel. Their lounge consists of 4 tables that sit 4 people(each)and the bar,?but the tables are pretty small. It was just me and?my husband?and after all of our food arrived there was no table room at all. So I can?t even imagine if we had two more people with us, we would need a second table for sure. Their chairs are pretty high and comfortable with nice padding, but they are sooo?heavy that it was a challenge to move them so I can sit down. But overall their decor really is beautiful and the bar stunning!???????????????????????????????????????????????????????????????????????????????????????????????????????????????4 stars
The food: In the lounge they have?a tapas menu which is not large, but the items on it are pretty good. On our first visit to the restaurant, once seated, they brought out their delicious house bread?which I completely adored, but on the second visit I was pretty disappointed when they didn?t bring any. It?s not that big of a deal since everything is 50% off but still if you return to a restaurant you go in with certain expectations, so I was a little bummed out.???????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????? 3.5 stars

Service: Server was very friendly and he checked up on us a couple of times during dinner. But our food did take about 15-20 mins to make it to our table, and since I was hungry and there was no house bread this time, I got impatient.??? 4 stars
Price: You can?t go wrong with their happy hour! Normally their tapas menu ranges between $5-$10 and their specialty drinks are $10 each so at happy hour everything is 50% off! Great deal!?????????5 stars
The verdict: Now that I?ve been to the restaurant twice I know the good and the bad, what I would order again and what I would pass on, but since the service, drinks, atmosphere and most of the food are great I would definitely come back again?to the restaurant! Mikey Weinstein of the Military Religious Freedom Foundation, headquartered in Albuquerque, N.M., said the scandals hurt U.S. military missions. His organization sent a letter to the head of the Marine Corps, Gen. James Amos, and Panetta on Thursday calling on them to "condemn this stomach-turning display without equivocation or delay and severely punish all of those responsible."
His organization released another photo showing a Marine and his rifle with the "SS" logo. According to the Marine Corps Times, embedded electronic information in the image shows that it was released by the Corps in 2004 and taken at the Marine Corps Air Ground Combat Center at Twentynine Palms, Calif. Two Marines in it were with a scout sniper platoon.
The newspaper said that suggests the practice is more widespread and that the logo's use is meant to signify "scout sniper," a position exclusive to the Corps. The Army has scouts and snipers, but considers the positions to be separate.
Weinstein said more needs to be done to stop its use.

To treat Muslims? complaints about dogs as if they deserve serious and respectful consideration is, of course, absurd. But over time, even the absurd becomes familiar. That?s one thing these people are counting on. They?re counting on their ability to wear the rest of us down gradually, accustoming us to ideas, beliefs, and ?sensitivities? that, at first blush, strike us as ridiculous. They?re counting on our ultimate willingness to compromise our values, one by one, out of fear of conflict and a misguided ardor for social harmony. They?re counting on our readiness to tell ourselves that we?re not surrendering or being submissive but are simply being good, respectful, cooperative neighbors.
It?s precisely in this way that sharia law is being introduced, step by inexorable step, into the West. The only way to put a halt to it is to ensure that everyone in a position of power in the West is aware of exactly what the Hasan K???ks among us are up to, and is willing to stand up to them every step of the way ? knowing that it?s not about dogs, but about dogma; not about puppies, but about power.

Cleveland -- The use of padded headgear and gloves reduces the impact that fighters absorb from hits to the head, according to newly published research from Cleveland Clinic.
In their biomechanics lab at Cleveland Clinic's Lutheran Hospital, the researchers replicated hook punches to the head using a crash test dummy and a pendulum. The impacts were measured under five padding configurations: without headgear or boxing gloves; with headgear and boxing gloves; with headgear but without boxing gloves; with boxing gloves but without headgear; and with mixed martial arts-style gloves without headgear.
The research published online today by the Journal of Neurosurgery measured both linear impacts and rotational impacts. (Linear impacts involve a straight-line collision of two objects, like a car driving straight into a wall in crash tests. Rotational impacts cause an object to rotate on its axis, such as the head rotating on the neck.)
The boxing-gloves-and-headgear combination proved the most effective in reducing impact forces. Though all of the padding combinations offered some reduction in linear impact forces, they did not lessen rotational impact forces.
"There is ample medical literature that points to rotational impacts as being key contributors to head and neck injuries," said lead researcher Adam Bartsch, Ph.D., Director of the Spine Research Lab in Cleveland Clinic's Center for Spine Health. "However, padding used for boxing and mixed martial arts are still designed to primarily reduce linear not rotational acceleration. More work is needed to develop better protective padding to minimize both linear and rotational forces."
The study supports the theory that head and neck impacts accumulate fastest in fighters who don't use protective headgear.
"These results show that gloves and headgear can offer some meaningful protection, proving that fighters especially young fighters should wear headgear whenever possible," said Edward Benzel, M.D., Chair of Cleveland Clinic's Department of Neurological Surgery.
The padding study is one of several projects Cleveland Clinic is undertaking to better detect and prevent brain injuries across a wide range of sports, including football, boxing, hockey and soccer. Teams of researchers are working to make safer youth football helmets (through a grant from NFL Charities); create an Intelligent Mouthguard that measures the number and severity of hits to the head among athletes; produce a blood test that can diagnose concussions; improve helmet safety by comparing modern helmets to vintage leather helmets; and develop an iPad app that uses the device's built-in gyroscope to quantitatively capture pre- and post-game measures of balance, memory and cognition. In Las Vegas, the Cleveland Clinic Lou Ruvo Center for Brain Health has launched a landmark study with professional fighters that will help determine whether MRIs of the brain, along with other tests, can detect subtle changes in brain health that correlate with impaired thinking and functioning. The research teams draw from their experiences of caring for thousands of professional, amateur and youth athletes every year on the sidelines and in clinic.
