Apply public trust doctrine to 'rescue' wildlife from politics

ScienceDaily (Sep. 29, 2011) ? When a species recovers enough to be removed from the federal endangered species list, the public trust doctrine -- the principle that government must conserve natural resources for the public good -- should guide state management of wildlife, scientists say.

In the Sept. 30 issue of the journal Science, the researchers note that the public trust doctrine holds that certain natural resources, including wildlife, have no owners and therefore belong to all citizens. So, they add, when federal statutory law no longer offers protection to a species, the public trust doctrine imposes upon states an obligation to conserve the species for their citizens.

The researchers cite the case of the gray wolf, which lost federal protection in the northern Rocky Mountains last spring under a rare Congressional legislative rider. This rider was passed after courts had reversed three previous U.S. Fish and Wildlife Service attempts to delist the wolf in the region, which includes Idaho, Montana and parts of Oregon, Washington and Utah.

The merits of protecting gray wolves have been hotly debated for years in the northern Rocky Mountains, where public opinion varies considerably among livestock owners, hunters and wildlife advocates. Idaho and Montana have launched public hunts aimed at reducing wolf populations since federal protections were lifted. Wolf advocates fear that heavy-handed "lethal management" of wolves could deplete the population so rapidly that the species will require federal protections again. Under the Endangered Species Act, the federal government monitors a species for at least five years after it is delisted, but state wildlife agencies take over management.

Lost in these bitter arguments is any attempt to clarify state agencies' obligation to their citizens, said Jeremy Bruskotter, assistant professor in Ohio State University's School of Environment and Natural Resources and lead author of the Science paper.

The wildlife trust doctrine, a branch of the public trust doctrine, defines that obligation, the paper's authors argue. The public trust doctrine has roots in ancient Roman and English common law, but its application to wildlife in the United States dates to the late 19th century. In an 1896 case, Geer vs. Connecticut, the U.S. Supreme Court ruled that the wildlife trust doctrine imposed on states a duty "to enact such laws as will best preserve the subject of the trust and secure its beneficial use in the future to the people of the state."

"If you recognize a wildlife trust doctrine, and that the state has the obligation to maintain these populations in perpetuity not just for current residents but for future residents, then there is a degree of protection for species in the absence of the statutory protection," Bruskotter said.

The researchers note that natural resource agency professionals are likely to be aware that all wildlife are communally owned by each state, but western politicians' open hostility toward this formerly protected species raises the question: What are states actually going to do?

"Some of the rhetoric about the killing of wolves might be political showmanship. But when they make exaggerated claims -- for example, comparing wolf restoration to the resurrection of the T. rex, which was done in Utah -- that adds layers of ambiguity and fear. Conservationists wonder if they will try to eliminate wolves and wonder if they can do it," Bruskotter said. "But the public trust doctrine holds that if state politicians were to intervene to try to prevent the maintenance of a viable wolf population, they could be taken to court. There is a legal mechanism to prevent that type of action."

Traditionally, the conservation and management of wildlife resources in the United States has been driven by state governments, which established agencies to monitor wildlife populations and regulate activities like hunting and trapping. However, the federal government began to take an interest in imperiled species in the 1960s, culminating with the passage of the Endangered Species Act in 1973.

"This is where the conflict turns. Until then, the impetus for wildlife management had come primarily from the states. Then the feds came in and said, 'We're taking over the protection and, hopefully, the recovery,'" Bruskotter said.

The federally led reintroduction of gray wolves to western states didn't sit well with many of those states' officials, who characterized the action as an unwanted federal intervention. When the wolf population was deemed to have met federal recovery goals in the region in 2002, state politicians began "clamoring for management authority," Bruskotter said.

To date, wildlife advocates haven't had to rely on the wildlife trust doctrine to guide their management because states generally show a strong desire to conserve species. The case of gray wolves in the northern Rockies has been unusual, with western legislatures continually expressing the desire to minimize or even remove wolf populations altogether.

While case law exists to define the reach of the public trust doctrine, additional case law would be beneficial to firmly establish states' obligations in the management of species no longer covered by federal protection, the authors contend.

"If this obligation is going to be more than just understood, there will need to be case law established, which is going to require somebody to take things to court to see what those obligations are," said Sherry Enzler, a co-author of the paper and a public trust scholar at the University of Minnesota.

The authors note that this argument for the application of the wildlife trust doctrine should not be construed as an appeal on behalf of the gray wolf.

"It's not about protecting any particular species. It's about how we ensure we have adequate protection for all imperiled species under state-led management. Not all species are a perfect fit for federal protection, so this is a better long-term solution," Bruskotter said.

"There is a middle ground here, and there is a legal process for defining this middle ground. States have an obligation to maintain, at minimum, a viable population of a species that has been removed from the endangered species list."

Better clarity about state management could also apply to the case of the grizzly bear, which the U.S. Fish and Wildlife Service stands ready to delist in the greater Yellowstone region. As part of a recent plan to remove protection, federal officials asked states to agree to certain management practices under a series of memoranda of understanding. A federal court rejected the plan because the memoranda were not legally binding -- states could not be compelled to conserve.

"This court-made law could be that regulatory mechanism," Bruskotter said, noting that this represents how the wildlife trust doctrine's application could support delisting a previously threatened species. "This common law could have been used to help remove grizzly bears from protection because it could have provided the regulatory mechanism the court sought in that case."

Private equity, bonds to drive ship finance amid credit crunch

Global shipping firms must look to private equity funds and corporate bond markets to obtain capital to expand their operations as traditional bank financing dries up in the West, industry executives said on Tuesday.

European banks, traditionally the top lenders to global shipping companies, have tightened credit lines as the region's sovereign debt crisis spills over to financial institutions.

The International Monetary Fund warned last week that the crisis had increased the risk exposure of European banks by 300 billion euros ($404 billion), and they needed to recapitalize to ensure they can weather potential losses.

"The capital market at this moment is shut," said Philip Clausius, chief executive of Singapore-listed First Ship Lease Trust Management , at an industry conference.

"The way forward is funding diversification as the old days of going to your house bank and getting the funding that suits you are over."

The economic gloom in Europe has amplified the pain for shipping companies, already struggling with rock-bottom freight rates and a glut of new vessels that were ordered when times were good.

Banks are more closely scrutinizing the companies they lend to and asking clients to provide higher downpayments in the difficult economic environment.

"In London in 2007, there were probably 18 banks that you could have visited. Today, it is probably nearer to 10 and when you visit those banks now you need a good strategic story," Nigel Anton, head of ship finance for Standard Chartered Bank, told Reuters on the sidelines of the conference.

Shipping firms hoping to protect market share from industry leaders A.P. Moller-Maersk (MAERSKb.CO), Mediterranean Shipping Company and others will need to find financing through alternative sources such as the corporate bond market and hedge funds.

"The weakening of valuations, cheap interest rates and the unavailability of credit has made publicly traded (shipping) companies prime candidates for private money," said the maritime and commodity brokerage firm Poten & Partners.

"The ability of private money to weather the near-term storm could bring salvation to those that are feeling the public pinch."

Ship owners warned, however, that private funding in the United States could prove more difficult due to the region's aversion to maritime investment.

"Most US money-market managers have no idea about shipping and they generally distrust it," said Graham Porter, director and co-founder of Seaspan , a leading containership charter owner.

"It's going to take a long time and a lot of rating agencies and everything else to build up that trust. This is not happening overnight."

Family members suspect drugs in 5 Ind. deaths (AP)

LAUREL, Ind. ? A driver in rural Indiana made a startling discovery, finding a young girl walking in the road, alone.

But what police found inside the 4-year-old's home was even more disturbing: four people dead, at least some of them shot. A fifth person was dead on a nearby property.

Indiana State Police were being tight-lipped Monday about the deaths, releasing few details as they investigated. Residents were left speculating about what brought violence to their area about 50 miles southeast of Indianapolis, and whether the danger had passed.

"People who haven't locked their doors in years, they're definitely locking up tight now," said Ryan Renfro, who lives nearby. "I actually took off work today because I'm here with my elderly grandparents and I didn't want to leave them here alone until they caught who they are looking for."

Sgt. Jerry Goodin, a spokesman for the Indiana State Police, did not say whether the shooter or shooters were believed to be among the deceased. He did say Monday that no manhunt was being conducted.

Police weren't releasing the names of the victims Monday. But people in this area, where many are related by blood or through marriage, talked about their relatives who had been killed. Those included four members of one family ? a man, his estranged wife and their two adult children ? as well as a neighbor who had gone to visit a member of the household.

Jewel Compston said her son, Henry Smith, 43, left the house they share Sunday morning to go to the home where the four bodies were found.

"He never made it back," she said, tearing up.

Compston said police told her early Monday that Smith had been shot to death.

Smith's aunt, Evelyn Renfro, lives nearby and said she heard shots around noon Sunday.

"Nobody went out because they were loading the cattle here and they didn't pay no attention to that," Renfro said.

Police wouldn't comment on motive, but neighbors said they had complained about drug activity in the area, and the sister of one victim said the family had been involved with drugs.

Teresa Richardson said the home where the bodies were found belonged to her sister's ex-husband, who lived there with the couple's daughter and son. She said her sister was visiting them Sunday.

She said police called her Monday afternoon and confirmed the four dead inside the home were her sister, Angie Napier, her sister's estranged husband, Roy Napier, daughter Melissa Napier and son Jacob Napier.

Teresa Richardson called the deaths a "senseless massacre" and said she blamed it on drugs. She said her sister and Roy Napier would have arguments that sometimes got physical, but she didn't think any of the family members would have turned on the others.

Debra Richardson, who can see the home from the greenhouse at her Pretty Petals florist shop next to her house, said she has complained frequently to police about what she believed to be drug dealers in the area, including at the mobile home.

"I have a greenhouse business, and they had more traffic than I do. I'm in here working in the greenhouse and I see people pulling in all the time. You don't have that many people visit you."

Huge Sun Storm Should Super-Charge Northern Lights Tonight (SPACE.com)

Particles that were blasted from the sun by a huge eruption over the weekend have reached Earth, causing geomagnetic storms on our planet, which will likely trigger a stunning northern lights show for some lucky skywatchers.

The particles reached at Earth at 8:37 a.m. EDT (1237 GMT) today (Sept. 26), kicking off moderate geomagnetic storms at lower latitudes and more serious storms closer to the Earth's poles, according to the U.S. National Oceanic and Atmospheric Administration (NOAA). These storms can disrupt GPS signals, radio communications and power grids, but no such effects have yet been reported, NOAA officials said.

The storms should also give skywatchers in select locations a treat, creating dazzling auroras (phenomena also known as the northern and southern lights). [Photos: Auroras Dazzle Northern Observers]

"Aurora watchers in Asia and Europe are most favorably positioned for this event, though it may persist long enough for viewers in North America," officials with NOAA's Space Weather Prediction Center (SWPC) wrote in an update today.

A powerful solar eruption

The sun unleashed a powerful solar flare and an event known as a coronal mas ejection (CME) on Saturday (Sept. 24). CMEs are massive clouds of solar plasma that can streak through space at 3 million miles per hour (5 million kilometers per hour) or more.

Luckily, this CME delivered a glancing blow. If it had hit Earth directly, the geomagnetic storms ? and, possibly, the damage ? could have been more serious. But we're not out of the woods yet, SWPC officials said.

The storm erupted from a region known as sunspot 1302. Sunspots are temporary dark patches on the solar surface caused by intense magnetic activity. The area around sunspot 1302 may be brewing up more trouble. [Photos: Sunspots on Earth's Closest Star]

"Region 1302 remains capable of producing more activity and will be in a favorable position for that activity to have impacts on Earth for the next 3-5 days," SWPC officials said.

For now, however, the biggest effect of the geomagnetic storms may be the auroras, so skywatchers in favorable locations should look up when they get the chance.

People in the mid- to high-latitudes should be alert for auroras after nightfall. The best hours to spot the northern and southern lights tend to be around local midnight, according to the website Spaceweather.com.

Sun ramping up

Sunspot 1302 has been particularly active lately, spouting off multiple X-class fares ? the most poweful type ? over the last few days. And that restlessness is part of a larger pattern, experts say.

Solar activity has been ramping up over the last few months as the sun has roused itself from an extended quiescent phase in its 11-year cycle of activity.

Just last month, for example, the sun let loose with an X6.9 solar flare, which was the most powerful solar storm since December 2006, NASA scientists said.

And the storms should keep coming over the next few years. Scientists expect activity in the current cycle ? known as Solar Cycle 24 ? to peak around 2013.

Rogue receptor opens door for rare kidney disease

ScienceDaily (Sep. 25, 2011) ? Effects of a particularly devastating human kidney disease may be blunted by making a certain cellular protein receptor much less receptive, according to new research by scientists from North Carolina State University and a number of French universities and hospitals.

The findings take a major step toward suggesting a beneficial treatment for rapidly progressive glomerulonephritis (RPGN), a rare but debilitating kidney disease that causes renal failure and death in humans.

In a paper published online in Nature Medicine, the researchers show that blocking the ability of the epidermal growth factor (EGF) receptor -- an important component in wound healing -- to bind with certain molecules in the kidneys of mice can eliminate the harmful effects of a mimic version of RPGN.

EGF receptors act like important keyholes on a cell's surface, says Dr. David Threadgill, professor and head of NC State's Department of Genetics and a co-author of the paper. Certain keys, or in this case molecules, can fit with the receptor and "open the door" to a cascade of cellular processes leading to inflammation, which can be good when your body needs to heal a wound or a cut. It's bad, however, when the inflammation runs amok, as when RPGN takes hold.

How important are EGF receptors in RPGN? When EGF receptors were taken out of the equation -- through special mice from Threadgill's lab that were genetically engineered without EGF receptors -- the disease was unable to take hold and degenerate kidney tissues.

The study also showed that certain drugs that inhibit EGF receptors -- think of them as pieces of gum in the keyholes -- not only prevented mouse kidneys from degrading but also reversed the harmful effects four days after mice were exposed to the RPGN mimic.

"EGF receptors are essential components for life, but are implicated in not only RPGN but also a number of cancers like colon cancer and breast cancer," Threadgill says. "They must be tightly regulated. If we can inhibit these receptors for short periods of time, we may be able to stop out-of-control cell proliferation and inflammation and thus prevent or treat certain cancers or diseases."

3D "Lion King" rules box office for second week (Reuters)

LOS ANGELES (Reuters) ? "The Lion King" fended off Brad Pitt to keep the box-office crown for a second straight weekend.

Walt Disney Co's 3D re-release of the animated classic rang up an estimated $22.1 million in U.S. and Canadian ticket sales over three days as families turned out to see lion cub Simba's return to theaters.

Baseball drama "Moneyball" starring Pitt took second and family film "Dolphin Tale" finished a close third, according to studio projections released on Sunday.

Ticket sales for "The Lion King 3D" have far surpassed industry expectations for a movie that debuted in 1994 and will soon hit stores on Blu-ray disc. The film has grossed $61.7 million in North American (U.S. and Canadian) theaters since its release last weekend, plus $16 million in international markets, where it came out more than a month ago.

Combined, the "Lion King" re-release has brought in $77.7 million around the world. Disney will extend the planned two-week run in theaters, said Dave Hollis, executive vice president for motion picture sales and distribution at Disney.

"We are working to meet that demand," Hollis said.

Brian Riedl, Grover M. Hermann Fellow in Federal Budgetary Affairs at the Heritage Foundation, argues providing an annual subsidy to farmers even when no damage occurs is a waste of taxpayer dollars. He notes the federal government does not write checks to homeowners regardless of whether their homes have been damaged.

Rose holds on to win BMW

LEMONT, Ill. ? Right when it looked as though Justin Rose might blow a big lead, he chipped in for birdie on the 17th hole to secure a two-shot victory Sunday in the BMW Championship that sends him to East Lake for a shot at $10 million.

Rose closed with an even-par 71 in the rain at Cog Hill for his first win of the year, and it came at just the right time. He was not assured of making the FedEx Cup finale at the Tour Championship, and now is one of five players who only have to win at East Lake next week to collect golf?s biggest bonus.

But it wasn?t easy.

Five shots ahead with 10 holes to play, Rose?s lead was down to one after he drove into the trees on the par-5 15th and made bogey. From just short of the 17th green, however, the 31-year-old from England holed a chip from 35 feet for an unlikely birdie that sent him on his way.

Senden shot 70, and his runner-up finish moved him from No. 55 in the FedEx Cup to No. 9, putting him among the top 30 from the 70 players at Cog Hill to advance to the Tour Championship.

Rose wasn?t the only big winner at the third playoff event. Geoff Ogilvy, who had to birdie the last hole at the TPC Boston two weeks ago just to stay alive in the playoffs, shot a 69 and finished alone in third. Now he?s in the Tour Championship, and qualified for the Presidents Cup at Royal Melbourne.

Indeed, there was more than one cup at stake on a dreary afternoon south of Chicago.

Rose captured the most important trophy - his third PGA Tour win, and the biggest of his career, that paid $1.44 million. The BMW Championship also was the final event for the top 10 players to qualify for the Presidents Cup.

Despite all the possibilities for the U.S. team, there was no change.

David Toms went from No. 10 to No. 8 with his tie for 10th. The heartache belonged to Bill Haas, who was tied for third at the BMW going into the final round. He was poised to claim one of the 10 spots until he posted a 42 on the back nine and shot 78, when a score of 75 would have been just enough.

?I knew if I played well, something good would happen,? Haas said. ?And I knew if I played bad, nothing would happen.?

It?s the second straight year that Haas walked away from Cog Hill feeling empty. A year ago, he finished 31st in the FedEx Cup by a mere seven points.

Hunter Mahan and Jim Furyk nailed down the last two spots for the United States. The other seven who had locked up spots were Matt Kuchar, Steve Stricker, Dustin Johnson, Phil Mickelson, Nick Watney, Webb Simpson and Bubba Watson.

Nothing but the order changed for the International team, either. Its list is based on the world ranking. Ogilvy, who was narrowly No. 10, moved ahead of Ryo Ishikawa to No. 9. The other eight players are Jason Day, Adam Scott, Charl Schwartzel, K.J. Choi, K.T. Kim, Retief Goosen, Ernie Els and Y.E. Yang.

For the FedEx Cup, Bo Van Pelt nailed down the 30th spot by a comfortable margin over Martin Laird. Even so, there were some tense moments. Despite difficult conditions, Camilo Villegas made nine birdies and had the best round of the day at 66. But he made bogey on the 18th hole, walked off the green to check a scoring terminal and slammed his fist onto the table.

The final round proved relatively flat, with only three players having a serious chance throughout the day. Rose was headed for a runaway when he birdied the sixth and seventh holes to reach 14 under, giving him a five-shot lead over Senden.

Back-to-back birdies for Senden around the turn, along with a bogey by Rose at the par-5 ninth, made it tight at the top. Rose did well to save par on the 13th and 14th holes.

Ogilvy, playing in the group ahead of Rose, ran off birdies on the 13th and 14th to get in the hunt. Ogilvy had good looks at birdie on three of the last four holes and failed to convert.

He made his goal of Royal Melbourne and East Lake. For a brief moment, he wanted more.

?It was a slightly flat feeling when you look back because I might have had a chance to win the tournament,? Ogilvy said. ?But who am I kidding? It?s my best tournament in months.?

Luke Donald, the world No. 1 who opened with a 75, closed with a 68 and finished alone in fourth. The top five players going to the Tour Championship are Webb Simpson, Johnson, Rose, Donald and Matt Kuchar. If any of them win at East Lake, they win the FedEx Cup.
